2013 PHOTO CONTEST

Submit your photos on the City Center Mankato Facebook Fan page. CityArt photo judges will choose one $25 winner each month in June, July, August, and September, then a Best of Show winner. The People’s Choice photo will be chosen by “Like” votes on City Center Mankato Facebook Fan page among the four Monthly Winners. Best of Show and People’s Choice winners will be notified in November, 2013.

 

Prizes include:

People’s Choice: $150, selected by Facebook “Like” votes from among the Monthly Winners (voting begins October 1st and ends October 31, 2013)

How to Enter

Step 1: Become a “Fan” of City Center Mankato on Facebook.

Step 2: Click on “Photos” and upload your favorite photos (up to 5) involving the CityArt Walking Sculpture Tour to the City Center Mankato Facebook wall.

Step 3: The judges will choose one winner for each month, June through September 2013. Those winners will be entered into the People’s Choice contest and their photos will be loaded into a separate People’s Choice album. Note: An individual can only be a monthly winner once during the contest year.

 

Step 4: If your photo is one of the selected monthly winners, encourage your friends, family, or anyone else to visit the page and “Like” your photo. The People’s Choice prize will be awarded to the photo with the most “Likes” at the end of the voting period. Please “Like” only one of the four photos in the People’s Choice portion of the contest. Note: Each photo will start back at zero “Likes” at the start of the People’s Choice voting period (October 1 – 31, 2013).

 

The Contest Details

We are looking for the best photos involving the CityArt Walking Sculpture Tour as determined by our judges and, for the People’s Choice prize, our fans on Facebook. Judges will be using creative criteria to choose photos with the best artistic merit and interpretation. We are looking for photos that are in good taste and show a positive reflection of the City Center. We will accept photos taken by you or photos of you. However, since photos of you are usually taken by someone else, you must have their consent to use the picture that you submit. No purchase is necessary to enter or win the Contest.

In entering the Contest you subject yourself to both the Contest Rules and Legal Terms and Conditions. By submitting images to the Contest, you are deemed to have reviewed, read and accepted both.


The Contest Period

The Contest runs from June 1, 2013 at 12:00:00 AM CT until 11:59:59 PM CT on September 30, 2013. Photos submitted before or after the contest period will not be eligible for consideration.

Contest Rules

 

  • No more than 5 photo entries per person will be allowed. The photos you wish to submit must be uploaded to the City Center Mankato Facebook fan page.
  • All work submitted must be original work. As such, you are required to comply with all U.S. and international copyright laws, any and all laws regarding intellectual property and you will indemnify CityArt and its affiliates for any violations in connection with the image(s) submitted.
  • No purchase necessary to enter the CityArt Walking Sculpture Tour Facebook Photo Contest.
  • We reserve the right to reject any photos which we, in our sole and absolute discretion, deem offensive, in violation of law, or unsuitable in any other manner. Examples of the following types of photos we will reject include the following:

    • Pornographic or nude images

    • Images promoting illegal drug use

    • Images depicting crimes of any nature

  • CityArt is not required to provide any explanation for the rejection.
  •  To receive the prizes for the Monthly Winners and the Best of Show, the photos submitted shall be judged by a panel of judges selected by CityArt. All decisions of the judges of the Contest will be final and binding. For the People’s Choice prize, the award will be chosen based on the number of “Likes” a photo receives. The photo with the greatest number of likes at the end of the contest will win the “People’s Choice” prize.
  • The CityArt Walking Sculpture Tour Facebook Photo Contest start and end date to submit photos will be stated on the City Center Mankato Facebook fan page. The winners will be announced within 30 days after the end of the contest. All winners will be notified by Facebook messages.
  • Entrants must be 18 years of age or older to enter the Contest. Entrants must also be legal residents of the United States, the District of Columbia, Puerto Rico or the U.S. territories and possessions.

 

General: Your entry into the CityArt Walking Sculpture Tour Facebook Photo Contest (the “Contest”) is subject to the Contest Rules, the following Legal Terms and Conditions, and all other guidelines, terms and conditions stated elsewhere on this site and all applicable laws, ordinances and regulations, including but not limited to all laws respecting intellectual property, trademarks, copyrights, rights of privacy, pornography and defamation. By entering the Contest, you accept and agree to be bound by the Contest Rules and these Legal Terms and Conditions. CityArt shall be the administrator of the Contest and shall sometimes be referred to as the “Administrator”.

Submissions of Photographs: All work submitted must be original work. Digitally enhanced images, manipulated or composites of multiple images must be derivations of the entrant’s original photos for which the entrant is the copyright holder. Furthermore, entrants agree to indemnify and hold harmless CityArt, its affiliates, subsidiaries, parents, directors, offices, and employees, against any and all claims, judgments, damages, liabilities, penalties and fines of any kind, stemming from any discovery that the submitted photo violates any and all applicable laws. By submitting your images, you grant CityArt and its affiliates the right to use, publish or disseminate any of your images in print and/or on our website, online publications, email newsletters or in any other manner we desire. You also waive any claims of ownership or copyright protection with the photos you submit.

Prizes: There are three different prizes:

  • Monthly Winners: $25, June thru September
  • People’s Choice: $150, selected by Facebook votes among the 4 Monthly Winners (voting begins October 1st and ends October 31, 2013)
  • Best of Show: $250, selected by our judges


Prizes will be awarded in the form of a check. All prizes will be awarded (assuming sufficient number of eligible entries). Limit: One monthly prize per family or household. CityArt is responsible only for prize delivery; it is not responsible for prize utility, quality or otherwise. Taxes and fees, if any, are the sole responsibility of winners. Winners shall indemnify, defend and hold harmless CityArt, its affiliates, subsidiaries, parents, directors, offices, and employees from and against any liabilities arising from or regarding taxes owed on prizes.

Judging: The photos selected for the Monthly Winner prizes and Best of Show prize shall be judged by a panel of judges selected by CityArt. The prize for People’s Choice will be selected by the number of “Likes’ a Monthly Winner photo receives from City Center Mankato “fans” on the Facebook page. All decisions of the CityArt Facebook Photo Contest judges will be final and binding.

Verification of Winners and Delivery of Prizes: Prize winners will be required to complete a IRS Form W-9. Prize may be awarded to alternate winner if:

·         W9 Form is not returned within 14 days after mailing to winner;

·         Prize notification or prize is returned as undeliverable;

·         Entrant does not respond to prize notification Facebook message within 7 days.

Winners agree to the use by CityArt of their name, address, likeness, images submitted and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law.

Eligibility: In order to participate in the Contest, you must be a legal resident of the United States, the District of Columbia, Puerto Rico or the U.S. territories and possessions. All federal, state, and local laws and regulations apply. Must be 18 years of age or older as of June 1, 2013 to enter. CityArt Committee members or staff and their immediate families and those living in the same household are not eligible to enter or win. Winning a prize is contingent on fulfilling all requirements set forth herein. CityArt reserves the right to verify the eligibility of winners.

Copyright Notice: CityArt respects the intellectual property of others, and we ask our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also in our sole discretion limit access to the site and/or terminate the memberships of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

 

Limitation of Liability: UNDER NO CIRCUMSTANCES SHALL CITYART OR ITS AFFILIATES BE LIABLE TO YOU OR ANY THIRD PERSON FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, RELIANCE, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, COST OF COVER, OR LOST DATA THAT ARISE IN WHOLE OR IN PART FROM THE USE OF, OR THE INABILITY TO USE, THE SITE OR THE SERVICES OR FUNCTIONS OF THE SITE OR ARISING OUT OF YOUR ACCESS TO, OR INABILITY TO ACCESS, THE SITE OR YOUR RELIANCE UPON, THE SITE OR THE SERVICES, CONTENT OR MATERIALS IN, OR FUNCTIONS OF, THE SITE, PROVISION OF, OR FAILURE TO PROVIDE SERVICES, OR INFORMATION, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND ON ANY THEORY OF LIABILITY (INCLUDING NEGLIGENCE). IN ADDITION, WE HAVE NO DUTY TO UPDATE THE SITE OR THE CONTENTS THEREOF. General Restrictions: This Contest is void outside the United States and where prohibited or restricted by law and subject to all applicable federal, state and local laws and regulations. This Contest will be governed by the internal laws of the State of Minnesota. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction within the United States. Administrator is not responsible for: (a) late, lost, stolen, damaged, garbled, incomplete, misaddressed, or misdirected entries, e-mails or other communications; errors, omissions, interruptions, deletions, (b) defects or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices or transmission lines; data corruption, theft, destruction, unauthorized access to or alteration of entry materials; loss or otherwise; or (c) electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind or insufficient space in entrant's e-mail account to receive e-mail messages. The use of automated software or computer programs to register or to enter this Contest is prohibited and any individual who uses or attempts to use such methods to register or to enter will be disqualified. Administrator disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Contest and reserves the right, at its sole discretion, to modify, cancel, terminate or suspend this Contest if any virus, bug, technical failure, unauthorized human intervention or other cause outside of Administrator’s control corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest. In the event of any such cancellation, termination or suspension, a notice will be posted and a random drawing will be held from among all eligible, non-suspect entries received prior to such time. Administrator reserves the right, at its sole discretion, to disqualify any entrant (and all of her/his Contest entries) from this Contest or any other promotion conducted now or in the future by Administrator or any of its affiliates if she/he tampers with the entry process or if her/his fraud or misconduct affects the integrity of this Contest. Administrator reserves the right to correct clerical or typographical errors in promotional materials. By participating in this Contest, each entrant accepts the conditions stated in the Contest Rules and these Legal Terms and Conditions, agrees to be bound by the decisions of the judges and warrants that she/he is eligible to participate in this Contest. By accepting prize, winner agrees to release Administrator and its directors, employees, officers and agents, including without limitation, its advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt and/or use or misuse of prize or participation in any prize-related activity.

 

Warning. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of this sweepstakes is a violation of criminal and civil laws. Should such an attempt be made, sponsor reserves the right to seek damages from any such individual to the fullest extent permitted by law.
